Hemp is recognized by the FSSAI as food

As of November 15th, 2021, hemp seeds and their by-products have been approved by the FSSAI and are 100% legal in India. The FSSAI has further permitted the free sale of hemp seeds and their by-products regarded as nutritional consumer products.

Legality & Conditions regarding Medical Cannabis in India

As mentioned in the NDPS Act, Cannabis extracts containing beyond 0.3% of THC are still considered illegal in India. Furthermore, an individual is only permitted to grow or use these extracts upon receiving the necessary license from the relevant authority, be it for medical or research purposes.

Legality & Licensing regarding Industrial Hemp

As clearly stated in the NDPS Act of 1985, Chapter 3, Section 14 – State governments are granted special authority to issue licenses for the cultivation and processing of Cannabis, as a special order or a general order for the production of fiber and seeds for industrial and horticultural usage.
